In the wake of the ever-increasing influence of EU law on private law, this study examines how infringements of European Union law in legal relationships between private parties can be remedied by the application of national law. In het licht van de toenemende invloed van het EU-recht op het privaatrecht, richt dit onderzoek zich op de manieren waarop schendingen van EU-recht in rechtsverhoudingen tussen private partijen worden voorzien van nationale oplossingen. EU law influences many fields of private law. However, remedies for infringements of European Union law in the context of legal relationships between private parties have to be found in the laws of the Member States. Examples include the law of obligations, tort law and laws governing compensation for damages. Remedies for infringements of EU law in legal relationships between private parties aims to inform the diverse actors in this field # that is, practicing lawyers, judges and legal scholars # about the ways in which infringements of European Union law in legal relationships between private parties can be remedied by the application of national law. The study draws upon a number of case studies, each exploring judgments delivered by the Court of Justice as well as the judgments delivered by the national courts after the preliminary procedures in question. The study touches upon key issues such as: The application of national remedies for infringements of EU law; The extent to which such national remedies comply with the principle of effective judicial protection, in particular the right to an effective and proportionate remedy under EU law; The challenges and subjects for debate that the current system of judicial protection gives rise to.
