European Private Law 2008/2010


European legislation has an ever growing influence in the field of private law. This volume brings together a wide set of European directives, regulations and treaties relevant to national private law. In addition to this, some European policy documents (in particular on the debate about European contract law) are included as well as various model laws, sets of principles and non-European treaties. All documents republished in this volume have in common that they are used in courses on European private law at Dutch universities.

One of the most important developments of the last few years in the area of European private law is the drafting of the Common Frame of Reference. The text of the draft (DCFR) is available on http://www.law-net.eu Because of its uncertain future, it was decided not to incorporate the complete text of the DCFR. Instead, the Principles on European Service Contracts (2006) and the Principles of European Sales Law (2008) are part of this volume. We also resisted the temptation to incorporate the Treaty of Lisbon (2007), of which the entry into force in January 2009 is not certain at the moment.

The editors like to thank UNIDROIT and the International Civil Aviation Organization (ICAO) for their kind permission to reproduce the text of the Convention on International Interests in Mobile Equipment and UNIDROIT for its permission to reproduce the Unidroit Principles of International Commercial Contracts 2004. We are also grateful to the editors of the Principles of European Contract Law, European Trust Law, European Insolvency Law and European Tort Law and to the Study Group on a European Civil Code for enabling us to include their texts in this volume.

All texts were updated until September 2008. Changes after that date have not been taken into account.

The first edition of this collection was edited by Jan Smits, Robert Hardy, Geerte Hesen and Nicole Kornet, at the time all affiliated with Maastricht University. This second edition was prepared at the Tilburg Institute of Comparative and Transnational Law.
